Case 1: Dispute regarding withdrawal of the contributions, and other matters

主な論争点：

(1)　ウィキペディアへの投稿は、投稿者が一定の条件下で依頼した場合に
削除されなければならないかどうか。

(2)　Tomosは日本語版の責任者としてそのような依頼に応じる義務があるか。

Major points of dispute:

(1) Whether or not contributions have to be deleted upon 
the request of the original contributor under certain circumstances. 

(2) Whether Tomos, as the leader of Japanese Wikipedia, is obligated 
to delete the requested pages.

経緯：

Background:

現在は無期限ブロックをされている利用者:Dolfinは、鳥類に関する投稿を、特定の
分類体系に基づいて行った。その特定の分類体系を選んだことについて他の参加者は
疑問を持ち、関係者の間での議論を呼びかけたが、失敗に終わった。議論の呼びかけに
対する拒否や、その他の協調性を欠いた行動のために、投稿ブロック依頼が出され、
実施された。

Dolfin, now a blocked user for an indermined period, has made contributions related to 
birds, among other things, based on a particular classification. 
His (/her) choice of classification was objectionable to others, and 
subsequent attempts for discussion among the concerned Wikipedians 
remained unsuccessful. The rejection of the call for discussion, along with 
other uncooperative behaviors Dolfin exhibited led to a request for the user's block, 
and soon it was acted on. 

ブロックの後、Dolfinの代理人がTomosにコンタクトをとり、Dolfinの
投稿を全て削除するように依頼した。当初、これは非公開の依頼であり、
Tomosは日本語版の代表的な立場にある者として依頼を実施する責任を
負うとされた。

After the block, an "agent" of the user contacted Tomos, requesting 
the deletion of the contributions made by Dolfin. Initially, 
the agent argued that the request remain to be confidential, and 
Tomos be solely responsible for fulfilling the request as the 
leading administrator of the Japanese Wikipedia. 

TomosはGFDLについての彼の理解（GFDLで一般公衆に与えられた許諾は
取り消しがきかないものである事）とウィキペディアの権力構造（Tomos
が独断で削除を実施したとしても、他の管理者によって復活され、Tomos
の管理者権限が剥奪されるだけで、独断による削除は有効な結果を生まない
仕組みになっていること）を元に反論した。

Tomos contested based on his understanding of GFDL (that Dolfin 
cannot effectively cancel the permission once granted by the GFDL) 
and the power structure of the Wikipedia 
(that even if Tomos deletes those pages, others will restore them, 
and Tomos be de-sysoped, making such attempt of unilateral deletion 
insignificant).

代理人はこれらの議論を否定し、Dolfin (ひいてはウィキペディアン一般)
とウィキペディアの間には暗黙の契約があるとし、ブロックによって
その契約が解消されたとした。代理人が示唆した契約の内容は、簡単に言えば、
Dolfinはウィキペディアで活動する権利を得、ウィキペディアはドルフィンの

Agent rejected those arguments, citing that there is an implicit 
contract between Dolfin (or any Wikipedian) and Wikipedia, and the 
contract was terminated upon the blocking of the user. The 
contract, according to the agent was, put simply, that Dolfin can 
contribute to Wikipedia and Wikipedia can publish the contributions. 
When Dolfin's right to make contributions is taken away by the block, 
then Wikipedia lost the right to publish (or keep exhibiting) those 
contributions. 

更なる議論の後、削除依頼はウィキペディア日本語版上で公開され、ウィキペディアン
の間で議論された。否定的な反応が多かった。また、3人の法律の専門家
（実務家または研究者）が、依頼にはTomosや他の管理者が当該ページを
削除することを義務付けるような法的な根拠はないとした。

After futher discussion between the two, the deletion request was made 
public on Japanese Wikipedia, leading to a discussion among Wikipedians. 
The general reception was negative, and three legal experts (either in 
practice or academia) suggested that the request does not have the 
legal ground to make Tomos (or the administrators in general) obligated to 
delete those files. 

代理人はそれに合意せず、責任を果たすためにはできるだけ早い削除の実施が
必要だとした。

The agent did not concede, and kept requesting Tomos the quickest 
deletion possible in order for Tomos to avoid liability.  

Tomos はJimbo Walesにメールでコンタクトをとり（そのメールは代理人
にもCCされた）状況と彼の理解するところを説明し、Jimbo がウィキペディアの
公式な代表として、Tomos に対して速やかな削除を命令するか、あるいは
この件は通常の削除依頼によって取り扱われるべきか、意見を求めた。

Tomos contacted Jimbo Wales via email (also CC-ed to the agent) 
explaining the situation, his understanding, and asking if Jimbo 
would order him an immediate deletion as an official leader of the 
project, or the matter should rather be treated via the regular 
deletion process on Wikipedia. 

Jimbo は、Tomosは現時点では当該ページを削除しないように、またこの件
は通常の削除依頼を経て取り扱うように、命令した。また、ウィキペディアン
は、代理人の示した法的な理由によってではなくて、礼儀・エチケット上の
理由によって、それらのページを削除することにしてもいいのではないかとも
示唆した。

Jimbo ordered that Tomos should not delete those pages at this point, 
the matter be treated via the regular deletion process. He also 
suggested that Wikipedians may decide to delete those pages out of 
courtesy, not for the legal reasons presented by the agent. 

代理人とTomosの連絡はしばらくの後途絶えた。

Communication between agent and Tomos became dormant shortly after the 
reply from Jimbo. 

今日、削除依頼は公式に合意も反対も得ておらず、合意形成を待っている状態
にある。

The deletion request has neither been officially accepted nor rejected 
until today the matter is still awaiting community concensus.
