IANAL but it is very likely that the guy is right, assuming we apply German law. Having the permission 
taking a picture surely does not imply a permission for showing the image in any media. Also the work 
is not yet public domain - for this we would have to wait until October 2008 (70 years after the 
creators death).  

IMHO we should remove the image immediately from the page it put it into a "black hole" until end of 
2008 - black holes as we know nowadays conserve information ;-) 

Die angegebene Fotografie wird auch nicht durch § 59 UrhG gedeckt, da sie offensichtlich nicht von 
einem öffentlichen Platz aus gemacht wurde.  

Meiner Meinung nach sollte die Fotografie daher sofort entfernt werden.
