The italian law permits to cite a work protected by copyright for "use of
criticism or discussion within the limits justified by this aim, provided
that it doesn't compete with the commercial use of the work; if the aim is
teaching or scientific research it must be for explanatory use and
non-commercial aim" (law n. 633 year 1941, art. 70). We have to mention
author, title, publisher and translator.
If the article is connected with an article on Wikipedia, the "use of
criticism or discussion" is assured, but if the articles doesn't refer to a
quote, that quote maybe exceeds the "justified limits". The "explanatory
use
and non-commercial aim" is sure.
Generally there isn't any competition with the commercial use (that is the
most important condition), but e.g. a collection of quotes by comic shows
(e.g. Simpsons) may be considered in competition with published collections,
if there is one. Daniele Luttazzi, an italian comic actor, asked us to limit
the number of quotes by his works (and deleted by himself the exceeding
ones).
So, our problem is the mention of author etc. We have many quotes without
any source (added by inexperienced users, or years ago), but we don't delete
them.
We prefer to signal all unsourced quotes and to search the sources
personally (this is the work done by Dread, the most active admin, now
inactive) or to encourage anonymous users to add sources (this is my work).
Anonymous users add sources even to old quotes daily.
However, here in Italy there are quotes without any reference everywhere:
books (collection for sale too), newspapers, magazine... And nobody
complains about that. We are certainly more serious and respectful of the
copyright law than the best part of the people.
