It's not a bug. The pages exist, and are thus eligible for indexing.
Negotiate a solution if you wish, but please don't falsely label the
issue.

Also, it partly defeats the purpose of protected a deleted page in that it encourages
vandals to force deletion protection because, at least, they'll have some way of
embarassing a non-notable person they target, particularly if there are uncharitable
comments on the linked to AFD page.
